Seahawks running back Marshawn Lynch was charged with two misdemeanor counts of drunken driving following a July 2012 arrest on Interstate 880 in Oakland. Under a plea deal, he pleaded no contest to a lesser charge of reckless driving and was sentenced to 12 hours of DUI school, two years probation and a $1,030 fine. He took the deal to avoid the publicity the trial would attract. He received endorsements after winning the Super Bowl, he didn't want a public trial that would put him in a negative light. His attorney Golde say that this resolution made sense for him, his team and for NFL.
Lynch blew a .08 percent blood alcohol level, and the breath test device used has a .03 percent margin of error. The arresting CHP officer gave inconsistent statements about how long he was following Lynch and the video/audio camera on his patrol car was not functioning that night, his attorneyGolde said. Lynch performed well during the field sobriety tests, he added.
The CHP officer said he was swerving as the reason for the traffic stop.
